1. Terms

By accessing the website at https://powerpuncher.eu, you agree to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

3. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on PowerPuncher's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not:

  • modify or copy the materials;
  • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • attempt to decompile or reverse engineer any software contained on PowerPuncher's website;

Prudent Europe Ltd. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, Prudent Europe Ltd. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

5. Limitations

In no event shall Prudent Europe Ltd., PowerPuncher, or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on PowerPuncher's website, even if Prudent Europe Ltd. or a PowerPuncher authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on PowerPuncher's website could include technical, typographical, or photographic errors. Prudent Europe Ltd. does not warrant that any of the materials on its website are accurate, complete or current. Prudent Europe Ltd. may make changes to the materials contained on its website at any time without notice. However, Prudent Europe Ltd. does not make any commitment to update the materials.

Prudent Europe Ltd. has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Prudent Europe Ltd. of the site. Use of any such linked website is at the user's own risk.

9. Warranty and Statutory Consumer Rights

Commercial Manufacturer Warranty:
Prudent Europe Ltd. provides a voluntary commercial warranty for PowerPuncher products as follows:

  • 2 years – manufacturing defects: All parts of the machine, including structural parts (frame, body parts, housing, screws, fan), moving and rolling parts (ropes, bungee cords, pulleys, rollers, bearings) and electronic components (display, motherboard, cables, sensors), are covered for 2 years against defects in materials and workmanship.
  • 1 year – premature wear: The following parts are additionally covered for 1 year against premature wear occurring under normal, intended use:
    • wear, moving and rotating parts (ropes, bungee cords, pulleys, rollers, bearings);
    • moving and connecting parts of electronic components (connectors, cables, buttons, charging port);
    • the built-in battery, if its capacity falls below 70% of its original value.

Normal wear and tear after this period, and wear resulting from excessive, improper or commercial over-use beyond the intended use, are not covered. Replacement wear parts are available for purchase at any time.

Statutory Consumer Rights:
Our commercial warranty applies in addition to, and does not limit or affect, your mandatory statutory rights under the applicable consumer protection laws of your country of residence.

  • For EU Consumers: You are entitled to a mandatory statutory legal guarantee of conformity of at least 2 years from the date of delivery.
  • For Australian Consumers: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
  • For US and Canadian Consumers: The commercial warranty above serves as our limited express warranty. To the extent permitted by law, any implied warranties of merchantability or fitness are limited to the duration of this express warranty.

How to Make a Warranty Claim:
In case of a warranty issue, please contact us using the details provided in the Contact menu. Please describe the problem and, where possible, attach photos or a short video, together with your order number.

Fast Repair Procedure:
For the sake of customer satisfaction, Prudent Europe Ltd. prefers fast and simple troubleshooting. If the customer agrees to this simpler and faster solution, Prudent Europe Ltd. will send the warranty replacement part directly to the customer and provide a video or electronic (PDF) repair guide. Upon request, we also offer live video assistance during the repair. This procedure is optional and does not limit the statutory rights of EU consumers, including the right to request repair or replacement of the product.

Warranty Shipping Costs:
For valid warranty claims made by EU consumers, Prudent Europe Ltd. covers the transport costs for returning defective parts and sending replacement components. For customers outside the EU, all shipping costs related to warranty claims, including the return of defective components and the delivery of repaired or replacement parts, are borne by the customer (unless otherwise required by mandatory local law, such as the Australian Consumer Law).

Warranty Exclusions:
The product is not made of stainless steel; therefore, it must be protected from high humidity and salty, marine air. We cannot provide a warranty for corrosion, rust, or damage caused by exposure to high humidity, moisture, improper maintenance, or normal wear and tear. The warranty also does not cover damage resulting from improper installation, including inadequate wall fixation (WALLMOUNT) or use without the required minimum ballast (STANDALONE), as specified in the user manual.

10. Right of Withdrawal and Returns

EU consumers have the right to withdraw from the purchase within 14 days of receiving the product, without giving any reason. The conditions of withdrawal, the return procedure and the bearing of return shipping costs are set out in our Return Policy, which forms an integral part of these Terms and Conditions.

In case of withdrawal, the direct cost of returning the product is borne by the customer. Warranty claims for defective products are not considered withdrawals and are handled as described in Section 9.

11. Service and Spare Parts

Ordering Spare Parts:
To order spare parts, please contact us using the details provided in the Contact menu. Spare parts are sent directly to the customer, and the repair can be carried out with the help of our video or electronic (PDF) repair guides.

Assistance Beyond the Warranty Period:
After the warranty period has expired, we can provide online live video assistance for repairs. Such assistance is provided on a case-by-case basis and may be subject to a fee. The customer will always be informed of any applicable fee in advance, before the assistance is provided.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Hungary and you irrevocably submit to the exclusive jurisdiction of the courts in Hungary, subject to mandatory local consumer rights applicable in your jurisdiction.
